Terms and Conditions
Acceptance of terms and conditions
By booking, or by you or your child attending a swimming lesson with us, you accept these terms and conditions and they will form a binding contract between you and us.
You will ensure that you or your child and any other children you bring to the swimming pool will follow the general swimming pool rules set out at the end of these terms and conditions and any rules displayed within the pool area at all times.
We reserve the right to vary these terms and conditions at any time upon reasonable notice to you. Changes will be advertised and made directly to the website.
Lesson Fees and payments
We run two types of swimming lesson courses as follows:
- Weekly lessons for a period of 11 to 15 consecutive weeks (depending on the length of the school term), not including school holiday breaks. Each lesson on a course will take place on the same day and time.
- Intensive courses of 5 days from Monday to Friday over a school holiday period. Each lesson on the intensive course is at the same time for 5 consecutive days.
All lessons will start promptly at the agreed start time. If your child arrives late to the pool, the lesson will not be extended and the lesson will still end at the agreed end time.
Course fees for swimming lessons vary per term. For specific details please refer to the Watford Swim School website. All fees must be paid in advance of the start date of a course and swimmers will not be allowed to participate in any swimming lessons until the fees are paid in full.
Weekly group lessons and one to two lessons are payable a term in advance in full. One to one lessons are payable half a term in advance.
If a swimmer joins mid-way through a course they will pay the remainder of the course at the point they join pro rata.
We accept the following payments
Bank transfer on the following details:
Sort Code: 09 – 01 – 29
Account no: 23488991
Reference: your childs first and second name
Cash on poolside – re-enrolling swimmers only
Before booking any course with us you must register your details with us either on our website www.watfordswimschool.com (hereafter website) or via a paper registration form.
Bookings may be made by email or by telephone and shall be on a first-come, first-serve basis. We shall not be obliged to accept your booking and shall not be obliged to provide any reason for not accepting your booking.
If you are booking concurrent courses for two children, we may at our complete discretion allow you to pay for the courses in two installments. You may request this installment option at any time.
If you wish to take a holiday during a course so that your child misses a lesson or lessons within the course, you must still pay for the entire course. You shall of course retain your place on the course for the duration of the course.
The fee is non-refundable. Watford Swim School teachers are contracted for the term in advance. We are therefore unable to refund any monies for sessions missed because of general illness to either parent/guardian or child, broken limbs, holidays confirmed prior to or taken during the term or for missed sessions because of late arrival or non-attendance.
If within 7 days of making a booking / payment you would like to cancel your booking, you will receive a refund of the fees paid, less an administration charge of 10% of the full amount. This offer does not apply to bookings made within 7 days prior to the start of the course, in which case no refunds or credits will be available, even in cases of sickness
All refunds are provided via bank transfer once we have received an email detailing the cancellation request, along with bank details: Bank Name, Account Holder Name, Sort Code and Account Number
If Watford Swim School does not receive the necessary banking details via email as detailed within 12 weeks of request, the refund will become null and void
If full payment for the term or crash course is not made within 2 working days (48 hours) of the booking being made, then we are unable to guarantee your place and it will be opened to other bookings.
We do not provide any refunds for Crash Courses once they have started.
Subject to the following paragraph, if your child refuses to get into the water or you decide you no longer want your child to attend the course, we will not give refunds or credits.
If however after three lessons, in our professional opinion your child is not happy in the water and/or having lessons and we feel it will not be beneficial for your child to continue with the course at that time, we reserve the right to cancel the remainder of the lessons in the course and will credit you for the lessons that your child has not been able to attend.
If you are ever dissatisfied with a class or teacher you must notify us immediately either by telephone or email and allow us the opportunity to resolve the issue. We will try to resolve the issue by offering a change in teacher, day or time. If after three lessons following your notification we are unable to offer a solution that satisfies you and you choose not to continue with the remainder of the course, we may in our absolute discretion offer you a refund for the unused lessons remaining in the course.
Medical Conditions and Individual Needs
If your child is ill you must telephone or email us by 9am on the day of your child’s lesson so that we are able to inform the teacher that your child will not be attending the lesson.
If there are any signs of stomach upset and sickness in your family on the day of your child’s lesson or in the 7 days before the lesson, you must inform us by telephone not later than one hour before your child’s lesson is set to commence and in the case of such notification, we reserve the right to cancel your child’s lesson(s), for the following 48 hours as a minimum, for the safety of your child and of others.
Children with heavy colds, sinusitis, ear infections, diarrhoea, vomiting, chicken pox and any other contagious diseases should not attend lessons whilst these symptoms show. If these symptoms show in siblings or family members, we advise against attending lessons and reserve the right to cancel your child’s lesson(s), for the following 48 hours as a minimum without providing a refund.
People diagnosed with cryptosporidiosis should not use swimming pools for 14 days after symptoms have resolved
If you have any queries with regard to further health problems please telephone us. We shall not be liable for your child catching any illness or disease whilst at our lessons.
Subject to the following, we will not provide refunds or credits for absence from booked lessons due to illness, regardless of the number of lessons missed as a result. However, if your child suffers a serious illness, which affects him or her for more than 4 weeks (such as broken bones or any condition that requires prolonged hospitalisation and/or medical attention) then we may offer you a credit for all lessons missed as a result of the condition if:
(1) you inform us of the condition and prognosis no less than 48 hours before the first lesson to be missed;
(2) you provide us with a doctor’s note detailing your child’s illness or medical condition;
(3) you accept that we will offer your or your child’s space to another person and we will try our best to offer you another suitable slot when you are ready to return to swimming lessons.
It is the parent/guardian’s legal responsibility to disclose any pertinent medical information regarding your or your children(s) lessons, or you and your baby (parent & baby lessons). This must be provided on the New User Registration Form or in writing to us via email to firstname.lastname@example.org, so the details can be included in the child’s medical notes on our database.
Cancellation by us
In the unfortunate event we have to cancel a lesson we will notify you either by telephone call, text message or by our website or Facebook page. We will endeavor to add an alternative date or offer to make up the lesson.
No refunds will be offered in the case of circumstances outside of our control such as bad weather conditions, power interruption, ‘acts of God’ as deemed to be contractually outside of our control.
If we determine that there is insufficient support for a course, we have the right to cancel, suspend or postpone the course before the date of the first lesson. We shall give you as much notice as possible of any such cancellation and we will provide you with a full refund of your course fee if no suitable alternative course is found. Our liability for any such cancellation shall be limited to this refund and we shall not be liable for any losses of any kind incurred by you as a result of such cancellation.
We will make every effort not to cancel lessons once a course has started but on rare occasions pool closure or other unforeseen circumstances may force us to do so. We shall give you as much notice as possible of any such cancellation. In this event we will offer you a substitute lesson on a date designated by us.
If you notify us that you are unable to attend the substitute lesson in advance of the date scheduled for the substitute lesson, then you will receive a credit for the cancelled lesson. This credit may be offset against your fees for a subsequent course. If you do not accept the substitute lesson or do not wish to re-enrol for a subsequent course, we are not obliged to provide a refund but may do this at our absolute discretion.
Requests to change lessons and teacher cover
You shall not have the right to change the day, time or teacher for your booked lessons for any reason once the course has started but we may entirely at our discretion choose to allow you to do so if we feel that you have reasonable grounds to request such change. This applies even if your circumstances or work commitments change.
We try to arrange that your child has the same teacher for each lesson within the course but we cannot guarantee this due to illness or holidays of the teacher and unforeseen circumstances. You may not claim a credit or a refund due to a change in teacher.
Re-enrolment - weekly lessons only
Shortly before the end of a course we will send an email and or text to the address / phone number on our system offering you the chance to re-enrol for the next course within a specified time-limit and setting out the fee for the course.
After the priority (existing customers) payment date, we fill the lessons with other swimmers. If you fail to pay on time and your space has gone, we will try to find you a suitable alternative. We cannot guarantee that we will be able to find you a suitable class, so please make sure you pay on time.
If you wish to re-enrol you must follow the re-enrolment procedure set out on our website
You are responsible for any children you bring with you into any part of the swimming pool including the changing area.
You must not leave the premises whilst your child is in the pool. If your child is in a one to one lesson with a teacher in the swimming pool and the teacher is ‘lone working’ we require you to stay on poolside at all times to maintain parental supervision of your child.
Children are not the responsibility of Watford Swim School or our swimming teachers until the child enters the swimming pool at the start of a lesson.
During lessons you must not interrupt or communicate with the teacher, distract the pupils or approach the poolside, unless it is a matter of health and safety.
You must keep children who are not swimming quiet and under your control at all times whilst in the swimming pool area.
You may not take photos or video recordings or any other type of recording of any children within the property unless specifically agreed in advance with Watford Swim School. All people within any photo or video MUST provide you with their full consent.
Watford Swim School will advise you if your child has reached a stage where they are too old or advanced for our lessons due to the length of the pool or general demand for that swimming level.
Please be aware that our lessons usually run with two or sometimes three teachers working alongside each other running their own separate lessons
Watford Swim School lessons are mostly run as 1-2-1 or 1-2-2 lessons with the instructor in the water with the child. In order for the swimming teachers to properly teach these lessons, they will need to physically handle the child in a professional manner to provide support in the water, and to convey correct stroke techniques.
Watford Swim School will not use or make available any personal information that we hold to any third party not directly responsible for or connected with the servicing of your booking. Watford Swim School will not use your personal information except to send you Watford Swim School promotions, course information and lesson notifications. If you wish to be removed from our mailing list please inform us by replying to one of the emails you have received, and your details will be unsubscribed from our mailing list
When parking your car, please respect our neighbour’s rights of access. You are welcome to park your car on the driveway of number 12 Stud Green, if a space is available.
